the OS, whether it's 32 or 64 bit, whether it's usb, pcmcia, expresscard or tied to strings don't matter.
what matters is the *device driver* and what *background processes* are going on.
background processes 99% cause the 'in use' bit. open task manager up and shut as much down as you can. common culprits include multimedia remote control doofers (like 'x10' remote things for windows media centre) and security software. or go for safe mode.
device driver failure usually gets you a '8020' mscomm control error when the CD that came with your adapter was written up by a drunken chimp. very rarely have i seen it cause an 'in use' issue except when there were a squillion 'old' drivers on the system from a user playing about too much. make sure to 'view hidden devices' and bin anything that you're not using any more.
